The focal point of the Phare project “Assistance to set up an efficient legal aid system” is to assist in the design and development of a new public policy on legal aid in Romania. This will lead to a consistent method of dealing with all types of legal aid including deciding who is eligible for aid, on establishing a standard of quality expected from the legal personnel involved in each case.

The overall objective of the project is improving the administration of and access to justice, while the specific objectives are the improvement of the legal and institutional framework on legal aid and the improvement of the level of awareness among diverse categories of population.

Throughout the project, the following results are to be achieved:

• Legislative and institutional assessment

• 5 workshops for judges, prosecutors, lawyers, bailiffs, National Agency for the Protection of Family, and Ombudsman personnel in order to identify alternative proposals for ensuring an effective quality legal aid for persons in need based on the models existing in EU Member States and in EU regulations and also to identify the training needs and proposals for ensuring continuing education of legal rights. The first round of workshops took place in Bucharest, Iasi and Cluj, over three days (11-13 June), while the final round were organised in the same three cities on 6th July.

• Feasibility study on the socio-economic, financial, institutional and statistic impact that can be brought by the adoption of new law provisions regarding the free legal aid

• Pilot court programme (Court of Justice District 2) in which the legal aid related activities are provided to citizens – legal aid level 1 (which consists in pre-trial, legal counselling). The pilot court programme had been running since 28th May 2007, and concluded on 22nd February 2008. For more information, please click here.

• Information campaign organised (seminars, brochures and informative materials with regard to the type of legal actions, access to lawyers, bailiffs, other informative activities, etc.)

The project concluded on 15th March 2008.
